Introduction
Welcome to AS Codeworks. By accessing our website or engaging our services, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.
Project Acceptance
When submitting a new project request, acceptance is subject to current developer availability. Our website may indicate that no developer is available for new requests at the time.
Project requests may also be declined based on project size, as we currently only handle small and medium-sized projects.
Work Transfer
By engaging our services, the client agrees and accepts that at any time and under any circumstances, AS Codeworks reserves the right to transfer, assign, or hand over the client's project work to another company, team, or developer. This may occur due to operational, health, or business reasons. The client will be notified of any such transfer. The quality and confidentiality obligations remain in effect regardless of who completes the work.
Working Days, Hours & Availability
Company Availability: Monday to Saturday (Sunday: Closed)
Developer Working Days: Monday to Friday (Saturday & Sunday: Off)
Working Hours: 10:00 AM to 6:00 PM (flexible schedule)
Developer Availability Status:
- Available — Developer is healthy and ready to take on work
- Limited — Developer is working at reduced capacity (minor health issues, personal commitments, etc.)
- Unavailable — Developer is on leave due to health or personal reasons
Project timelines may be adjusted based on developer health and availability. Clients will be notified of any changes that may affect their project schedule.
Communication
Once your project has been accepted, all communication must be conducted through the official business contact details. Direct communication with the developer is not permitted.
Work Quality
All project work should be acceptable by the client as per standard market quality. We strive to deliver the best possible work quality for every project.
Use of Artificial Intelligence in Development
At AS Codeworks, our developers are fully trained to manually code any software from scratch. However, to deliver faster results and stay at the forefront of modern development practices, our developers actively use Artificial Intelligence (AI) tools and services as part of their workflow.
AI-generated code is always reviewed by our developers. Any code produced with the assistance of AI tools is not blindly copied and pasted into your project. Every AI-generated output is carefully reviewed, validated, tested, and refined by our developers to ensure it is bug-free, secure, and meets the performance and quality standards of your project. This review process is a core part of our development workflow.
As a result, the speed and scope of your project's development may depend in part on the availability, performance, and capabilities of the AI services used by our developers. If any AI service experiences outages, policy changes, capability reductions, or is discontinued, this may impact development timelines — potentially increasing the time required to deliver the same quality of work.
By engaging our services, the client acknowledges and accepts that:
- AI tools are used internally by our development team to enhance productivity and delivery speed.
- All AI-generated code is reviewed and validated by a developer before being included in the project — ensuring security, correctness, and quality.
- Any disruption, limitation, or change to an AI service may affect project timelines.
- AS Codeworks will communicate any such impact as soon as it is known and work to minimise delays.
- The client will not hold AS Codeworks liable for delays directly caused by changes in third-party AI service availability or capability.
Project Payment & Prepayment
Split Prepayment: Project payments are split based on work milestones. A percentage of the total project cost is required as prepayment before development begins. Each time the project resumes after a pause or milestone, an additional prepayment is required to continue work. The exact percentages will be agreed upon in writing before the project starts.
Third-Party Services: Any third-party services, licences, subscriptions, or assets that need to be purchased on behalf of the client require 100% prepayment in full before purchase. These costs are separate from the development fee and are non-refundable once purchased.
Refund Policy: All payments are non-refundable unless there is a valid reason with documented proof that the issue is a direct result of a fault on our business side.
Project Progress Reports
A project progress report and a live or recorded preview of the work completed will be provided to the client at each defined completion milestone (e.g. every 25%, 50%, 75%, and 100% of completion). The exact milestone points will be agreed upon before the project starts.
Project Pricing
During project development, the project pricing can change as per project requirements. Any changes to the agreed pricing will be communicated to you in writing with proof before being applied.
App Services Subscription & Payment
For app services that involve ongoing or recurring development (Android App, iOS App, Desktop Software), the following payment terms apply:
- Without a ProjectCare Plan: The client must commit to and pay for a minimum of 12 months of service duration in full, upfront, before development or maintenance work begins. This ensures continuous developer availability and project continuity throughout the engagement.
- With an Active ProjectCare Plan: Monthly payment is acceptable for app services. Payments are due at the beginning of each billing month, and services continue as long as the ProjectCare Plan remains active and payments are current.
- If a ProjectCare Plan is cancelled or lapses, any remaining balance must be settled and, if services are to continue, the client must switch to the full upfront payment model as described above.
Shared Infrastructure for Maintenance Plan Clients
Clients on an active Maintenance Plan receive complimentary access to shared hosting infrastructure — including web server, domain hosting, CDN, SSL/TLS security, and basic application services — at no additional cost, provided usage remains within reasonable limits for a standard-sized application.
This shared infrastructure is used by multiple client applications simultaneously. Server resources, bandwidth, and storage are distributed across all clients on the shared environment. By accepting a Maintenance Plan, you acknowledge and agree to this shared-resource arrangement.
If your application requires any of the following, you will need to provision your own dedicated server and services, billed separately at cost:
- High traffic volumes or sustained resource-intensive workloads that exceed normal usage for your application size
- Isolated infrastructure for performance, security compliance, or regulatory requirements
- Custom server configurations, dedicated IP addresses, or services not supported in the shared environment
AS Codeworks reserves the right to require a client to migrate to dedicated infrastructure if their application's resource usage negatively impacts the shared environment or other clients. Reasonable advance notice will be provided before any such migration is required.
Intellectual Property
AS Codeworks retains the right to reuse general-purpose code, frameworks, and non-client-specific components. Any third-party libraries or services included in the project remain subject to their respective licences.
Limitation of Liability
AS Codeworks shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Project timelines may be adjusted based on developer availability and health status. Clients will be notified of any changes that may affect their project schedule.
